1. Acceptance
By using Business Loans for America (the “Service”), operated by Ellipsis Capital LLC (“Ellipsis Capital LLC”, “we”, “us”), you agree to these terms. If you do not agree, do not use the Service.
2. We are not a lender
Ellipsis Capital LLC is a financing marketplace and brokerage. We are not a lender, bank, or credit union. We do not make loans, we do not make credit decisions, and we do not determine the rates, fees or terms of any financing. All financing is originated by third-party lenders who underwrite and decide independently.
3. No guarantee of approval or funding
Submitting an application does not guarantee that you will receive an offer, that any offer will be on particular terms, or that financing will be funded. Any amounts, rates, timeframes or approval odds described on the Service are illustrative or typical outcomes, not guarantees or offers of credit.
4. How we are compensated
We are typically paid a commission by the lender when a transaction funds. We charge you no fee to apply, to receive offers, or to decline them. Because our compensation may vary between lenders, a potential conflict of interest exists; you should compare any offer on its own terms before accepting it. See our Disclosures.
5. Eligibility
You must be at least 18, located in the United States, and an owner or authorised representative of the business you are applying for, with authority to submit the application and to provide the consents in these terms.
6. Accuracy of information
You agree that everything you submit is true, accurate and complete, and that you will keep it current. Submitting false or misleading information may result in declined applications, termination of access, and referral to authorities where fraud is suspected.
7. Consent to be contacted
By submitting an application you consent to be contacted by Ellipsis Capital LLC and by lenders in our network about your application, by telephone, email and SMS, including at the number you provide. See our SMS Terms and Privacy Policy.
8. Not financial, legal or tax advice
Content on the Service, including guides, calculators and estimates, is general information only. It is not financial, legal, accounting or tax advice, and it does not account for your circumstances. The payment calculator is an arithmetic illustration, not an offer of credit. Consult a qualified professional before entering into any financing.
9. Acceptable use
- Do not submit applications for a business you are not authorised to represent.
- Do not scrape, mine or bulk-download the Service.
- Do not attempt to interfere with, probe or circumvent the Service’s security.
- Do not use the Service for any unlawful purpose.
10. Intellectual property
The Service, including its text, design, and code, is owned by Ellipsis Capital LLC or its licensors and is protected by intellectual property laws. You may not copy, republish or create derivative works from it without permission.
11. Third-party lenders and links
We do not control third-party lenders and are not responsible for their products, decisions, conduct, or privacy practices. Any agreement you enter into with a lender is between you and that lender.
12. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
13. Limitation of liability
To the fullest extent permitted by law, Ellipsis Capital LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenues or data, arising out of your use of the Service. In no event will Ellipsis Capital LLC’s aggregate liability to you for all claims relating to the Service exceed one hundred dollars ($100).
14. Indemnification
You agree to indemnify and hold Ellipsis Capital LLC harmless from claims arising out of your use of the Service, your breach of these terms, or information you submit.
15. Changes
We may update these terms. Continued use after a change means you accept the updated terms. The date at the top shows when they last changed.
